Which days in the month are working days?

There are working days, Sundays and public holidays - working days can in principle be any day. Working days are the days in the period from Monday to Saturday inclusive; for most employees and civil servants, working days are in the period from Monday to Friday.

What holidays or weekends are for some are working days in restaurants, hospitals, the police and many other professions. If, however, work is also often carried out on Saturdays, Sundays and public holidays, this has a major impact on the actual working days over the months and throughout the calendar year. It is therefore of great relevance for employees to calculate the correct number of actual working days for their own tax return.

For this purpose, there is a query in the working day calculator as to whether days should be added up due to work on Sundays and public holidays. Conversely, you have to subtract all your vacation days and sick days from all possible working days (the total days) in order to calculate the real working days. The working day calculator will also ask you for this.

 

How many working days does the tax office recognize?

You can claim the commuter allowance in your tax return for every day that you drive to your regular place of work. Many tax offices do not require any calculations or proof, but accept common calculations of working days:

  • for a 4-day week: 180 working days
  • for a 5-day week: 230 working days
  • for a 6-day week: 280 working days

Important: This number is based on experience. You have no legal right to it. Ultimately, the number of working days depends on your individual circumstances. It is therefore important to calculate the correct number of working days for your tax year.

If your tax return shows that you drove to work on fewer days than usual, for example when receiving sick pay or when you state that you work away from home for several days, the tax office often shortens the working days.

 

This applies to work on Sundays and on public holidays

In principle, employees may not be employed on Sundays and public holidays from midnight to midnight. This is in the Working Hours Act (ArbZG). There are of course exceptions to this principle, otherwise hospitals, police, restaurants, petrol stations and many other industries would have a problem. Therefore, the Working Hours Act also regulates that - if the work cannot be carried out on working days - employees in numerous areas are also employed on Sundays and public holidays.

However, the employer may not order an employee to come to work every Sunday: 15 Sundays a year must remain free. In addition, the employee must be granted a substitute rest day for every Sunday or public holiday on which he has worked.

By the way; Many employers pay a Sunday bonus or a public holiday bonus. However, there is no legal entitlement to this!

 

Working days with teachers

For teachers in general education schools in particular, many tax offices also deduct the vacation days and only accept significantly fewer working days. For example, a few years ago a teacher at a grammar school only recognized travel expenses for 192 journeys because he did not provide a list of the additional journeys.

As a teacher, you should therefore keep a record of the number of days you went to school during the holidays or at the weekend, or you should provide evidence of the number of work days claimed by means of an employer certificate. This saves queries from the tax office.

What does the Working Hours Act mean for working days?

The Working Hours Act (ArbZG) basically regulates how employees may work hours. This includes the maximum number of working hours, the working hours, as well as rest or break times and special cases such as shift or night work. The Working Hours Act is binding. A regular number of a maximum of 8 hours per day applies to full-time employment. In exceptional cases, 10 hours are allowed. The prerequisite for this, however, is that the overtime can be reduced within 6 months or that the employer compensates it financially.

Furthermore, the break times are also subject to the working hours. The law stipulates that employees are allowed at least 30 minutes' break for 6 hours or more. For working days with a workload of more than 9 hours 45 minutes.

How does the BUrlG influence the number of working days?

The Federal Leave Act (BUrlG), however, stipulates how many days employees are entitled to paid vacation per year. In Germany, for full-time employment, calculated with 5 working days of 8 hours per week, 24 days of vacation are required. Working days are counted. Weekends are not counted. Industry-specific deviations, if the occupation provides for around 6 working days, require more vacation days accordingly. The vacation entitlement must therefore be adjusted to the number of actually applicable and worked days. Since you do not have to or should not work on the vacation days, our working day calculator provides that you enter the working days on which you took vacation or were reported sick separately in order to arrive at the net number of your working days. These play a role in the tax return so that, for example, income-related expenses such as travel expenses can be correctly accounted for.

Special case of holiday work:

In our working days calculator, we also take working days into account that are actually not. Because Sundays and public holidays are actually not working days and therefore not working days. In various industries, however, it is necessary that holidays and Sundays are treated like working days in order to maintain public order (justice, military, security industry) or the functionality of social life (nursing and care for the elderly, transport companies, fire brigade and emergency services) receive.

If you worked on Sundays or public holidays in the last year, please also enter the number of these days as separate working days in the calculator. This is the only way to get a correct result for the number of working days in the applicable tax year.

 

Questions and answers about working days

How many working days are there per month?

The number of working days per month varies depending on whether you are employed in a five-day or six-day week. The number of weeks and workdays per month also plays a role in the calculation. For example, February is shorter than August, which is why you have fewer working days in February. On the other hand, August is a classic holiday month, which means that you can actually have fewer working days in August than in February.

Furthermore, when measuring the number of days worked per month, it must also be calculated whether a certain number of days were reported sick or whether there were public holidays that cannot be counted as working days. A general answer to the question about the number of working days per month is not possible due to these many factors.

How many working days can you include in your income tax return?

When specifying the working days in the tax return, the tax offices usually use the so-called non-acceptance limit as a basis. This limit is used to measure amounts and information without a more detailed examination; about the number of working days that is usual on average. However, one should not rely on the practice of the non-acceptance limit.

A five-day week results in an average non-acceptance limit of 230 working days per year. A six-day week on average corresponds to 280 working days per year. If you have more than 230 working days in a contractually agreed five-day week, you have to expect that the tax office will want receipts for the overtime so that they can be taken into account in the tax return.

How many working days per week are allowed?

The maximum permitted working time is clearly regulated in Section 3 of the Working Hours Act. This is 8 hours per day. Because the Working Hours Act regards Saturday as a working day, the maximum permitted working time per week is 48 hours, spread over a maximum of 6 working days per week, which the law provides and allows.

In exceptional cases, 10 hours per working day are permitted. However, this workload may not be worked for more than 6 months at a time. Breaks during working days are not counted as working time, which increases the perceived working time to 42.5 to 45 hours per week (with 5 working days per week) or 51 to 54 hours (with 6 working days per week).

Where do you have to enter the working days in the tax return?

The number of working days is entered in Appendix N of the income tax return. Lines 31 to 40 are reserved for information on the number of working days. From line 32 you enter the working days per week. In the following, vacation days taken and any sick days are entered in the tax return. From line 36, the working days of the entire tax year are noted - sick days and vacation days are already deducted at this point in the tax return.
